What’s At Stake When You Miss A DUI Court Appearance?

After you have been charged with the crime of driving under the influence, or DUI, to a certain degree your right to choose goes away. Nowhere is the loss of privilege more prevalent than when it comes to court appearances. Failure to appear in court for any session about your charge comes along with consequences.

Loss of Freedom

The primary consequence that comes along with missing a court appearance for a DUI is jail time. This is a serious charge. As a result, in order to be released, the defendant is generally required to post bail. When the individual fails to show up for a future court appearance, this bail may be revoked, and the individual remanded into custody. Generally, the person will have to stay in jail until the court case has been decided on, which could be months. 

No Alternative Sentencing

For first-time offenders or those with minimal criminal histories, judges can practice alternative sentencing measures in lieu of jail. This sentencing can include community service or behavioral or substance abuse treatment programs. These programs are only offered to defendants who show up in court to help argue their case. It is not offered to those individuals who do not take the matter seriously and don't bother to show up.

Late Equals Missed

It's important to understand that in a court of law, late is the equivalent of absent. For instance, most courtrooms have a window in which cases are heard, such as from 10-2. If you show up at 1:30, but your case was heard at 11:00, the judge does not have to rework the docket to accommodate your tardiness. It will appear on the record that you missed your appearance and you will be subject to all the penalties that come along with this behavior.   

Notify Your Attorney

It's best to have an attorney represent you for such a serious charge. Not only will an attorney fight for you, but he or she can help in the event you need to miss a court appearance. For example, if you have a court appearance and there is no way you can take off on that day or you have a family emergency, an attorney can typically file a motion to have the court session delayed. Without an attorney performing this step, you'd be in trouble.
